3. Personal Data We Process

When you visit or use the website, we may process the following categories of personal data:

3.1 Technical Website Data

When the website is accessed, technical data may be processed automatically, including:

  • IP address;
  • date and time of access;
  • browser type and version;
  • operating system;
  • referring URL;
  • pages visited;
  • device information;
  • log files and security-related information.

This data is required to make the website available, maintain website security, detect misuse, and ensure technical stability.

Legal basis: Article 6(1)(f) GDPR — our legitimate interest in operating a secure, functional, and stable website. GDPR Article 6 sets out the lawful bases for processing, including consent, contract-related processing, legal obligations, and legitimate interests.

4. Contact Form and Training Requests

The website includes contact and request options, including fields for name and email address. The website states that visitors can submit requests for the technical training workshop and that Tamares will respond with options, costs, and availability.

If you contact us through the website, by email, or by phone, we process the information you provide, such as:

  • name;
  • email address;
  • company name, if provided;
  • phone number, if provided;
  • message content;
  • requested training, workshop, rental, or service details;
  • communication metadata.

We use this data to process and respond to your enquiry, prepare offers, coordinate training-room or workshop availability, and communicate with you.

Legal basis:
Article 6(1)(b) GDPR, where the enquiry relates to pre-contractual steps or a potential contract; and
Article 6(1)(f) GDPR, where we have a legitimate interest in responding to business enquiries and maintaining business communications.

5. Newsletter / Subscription

The website includes a subscription field inviting visitors to sign up to hear about upcoming events.

If you subscribe to updates, we process your email address and, if applicable, your consent status and subscription metadata.

We use this data to send information about upcoming events, training services, or related offers.

Legal basis: Article 6(1)(a) GDPR — your consent.

You may withdraw your consent at any time with effect for the future, for example by using an unsubscribe link in the email or contacting us at hello@tamares.ch.

Implementation note: If newsletter emails are used for marketing, ensure that a compliant opt-in process is implemented, preferably double opt-in, and document consent records.

6. Cookies and Similar Technologies

The website displays a cookie notice stating that cookies are used to analyze website traffic and optimize the website experience, and that accepted data is aggregated with other user data.

Cookies and similar technologies may be used for:

  • technical website functionality;
  • security;
  • remembering cookie choices;
  • analytics;
  • optimization of the website experience.

Under German TDDDG Section 25, storing information on a user’s device or accessing information already stored on a user’s device generally requires the user’s consent, unless an exception applies.

Legal basis:
For technically necessary cookies: Article 6(1)(f) GDPR and, where applicable, Section 25(2) TDDDG.
For analytics, optimization, or non-essential cookies: Article 6(1)(a) GDPR and Section 25(1) TDDDG — your consent.

You may change or withdraw your cookie consent at any time through the cookie settings made available on the website, or by deleting cookies in your browser settings.

Implementation note: The cookie banner should allow visitors to reject non-essential cookies as easily as accepting them. Non-essential analytics or marketing cookies should not be set before consent.

7. Google reCAPTCHA

The website states that it is protected by Google reCAPTCHA and that Google’s Privacy Policy and Terms of Service apply.

Google reCAPTCHA is used to protect website forms from spam, bots, and automated misuse. When reCAPTCHA is used, Google may process technical data such as:

  • IP address;
  • browser and device information;
  • user interaction data;
  • cookies or similar identifiers;
  • referrer URL;
  • date and time of access.

Provider:
Google Ireland Limited
Gordon House, Barrow Street
Dublin 4
Ireland

Depending on Google’s processing setup, data may also be transferred to Google LLC or other Google entities outside the EEA. Google states in its reCAPTCHA documentation that it commits under its Cloud Data Processing Addendum to comply with GDPR in relation to processing customer personal data in Google Cloud services, including reCAPTCHA.

Legal basis: Article 6(1)(f) GDPR — our legitimate interest in protecting the website from spam, abuse, and automated attacks. Where reCAPTCHA or related technologies access or store information on the visitor’s device beyond what is strictly necessary, consent may also be required under Section 25 TDDDG.

8. Hosting and Technical Service Providers

We use technical service providers to operate, host, maintain, secure, and improve the website. These providers may process personal data on our behalf, including technical log data, form submissions, and cookie or analytics data.

Categories of recipients may include:

  • website hosting providers;
  • domain and DNS providers;
  • website builder or CMS providers;
  • IT support providers;
  • email and communication providers;
  • analytics and security service providers;
  • anti-spam and bot protection providers.

Where service providers process personal data on our behalf, we use appropriate data processing agreements as required by Article 28 GDPR.

Implementation note: Insert the actual hosting provider, website platform, analytics provider, CRM/email provider, and newsletter provider once confirmed.

9. Transfers to Switzerland and Other Third Countries

Tamares GmbH is headquartered in Switzerland. Personal data collected through the website may therefore be processed in Switzerland.

The European Commission has recognized Switzerland as providing an adequate level of data protection. The Swiss Federal Data Protection and Information Commissioner states that the EU deemed Switzerland to provide an adequate level of data protection and that, in its 15 January 2024 report, the EU determined that Switzerland has an adequate level of data protection based on the GDPR as well.

Where personal data is transferred to countries outside the EEA or Switzerland that do not have an adequacy decision, we rely on appropriate safeguards, such as EU Standard Contractual Clauses, or another lawful transfer mechanism under GDPR Chapter V.

10. Retention Periods

We retain personal data only for as long as necessary for the purposes for which it was collected, unless statutory retention obligations require longer retention.

Typical retention periods are:

  • Technical log data: usually deleted or anonymized after a short security retention period, unless longer retention is required to investigate misuse or security incidents.
  • Contact enquiries: retained for as long as needed to respond to the enquiry and manage the business relationship.
  • Offer and contract-related communications: retained in accordance with applicable commercial and tax-law retention obligations.
  • Newsletter data: retained until you unsubscribe or withdraw consent, unless proof of consent must be retained for legal defence purposes.
  • Cookie consent records: retained for as long as required to document consent and compliance.

11. Your Rights

Subject to the legal requirements, you have the following rights under the GDPR:

  • right of access;
  • right to rectification;
  • right to erasure;
  • right to restriction of processing;
  • right to data portability;
  • right to object to processing based on legitimate interests;
  • right to withdraw consent at any time with effect for the future;
  • right to lodge a complaint with a supervisory authority.

The GDPR provides these rights in Articles 15 to 22, and Article 77 provides the right to lodge a complaint with a supervisory authority.

To exercise your rights, contact us at:

hello@tamares.ch

12. Right to Object

Where we process personal data on the basis of Article 6(1)(f) GDPR, you have the right to object to such processing at any time on grounds relating to your particular situation.

If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or unless processing is required for the establishment, exercise, or defence of legal claims.

13. Withdrawal of Consent

Where processing is based on consent, you may withdraw your consent at any time with effect for the future.

Withdrawal does not affect the lawfulness of processing carried out before withdrawal.

14. No Automated Decision-Making

We do not use personal data collected through this website for automated decision-making within the meaning of Article 22 GDPR.

15. Data Security

We use appropriate technical and organisational measures to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or unauthorized access.

These measures include, where appropriate:

  • access controls;
  • secure transmission;
  • system monitoring;
  • provider due diligence;
  • restricted access to enquiries and communications;
  • technical safeguards against spam and automated misuse.

16. Changes to This Privacy Policy

We may update this Privacy Policy from time to time, for example if website functions, service providers, or legal requirements change. The current version will be published on this website.
